Big court decision in abortion battle

Big news on the abortion front, the 4th District US Court of Appeals shot down a Virginia law banning a late term abortion procedure. The reason it was shot down is that it did not provide for someone who might need the procedure out of medical necessity or at the risk of their own life. The ruling is certain to get conservatives in an uproar and stir more debate about the courts in Congress. According to the article (from the Washington Post via Yahoo), the 4th district is actually considered one of the most conservative appeals courts.

There are two reasons that partial birth abortion bans don't include a health exception. The first is that there have been a grand total of zero demonstrated cases in which a partial birth abortion was the best medical option. The second is philosophical - what does "health" mean? One could argue that anything that makes you gain 25 or 30 pounds in 9 months is unhealthy.

This type of case is why social conservatives are so eager to get their people appointed to judgeships. Ever since 7 Supreme Court judges found the invisible ink in the Constitution guaranteeing the right to abortion in 1973, this battle has been raging, and I don't see it ending anytime soon.
